Well-known football lawyer Yuriy Yurchenko commented on the news that the Kyiv Pechersk Court banned the UAF from holding presidential elections in this organization in the context of possible violations of FIFA standards on the inadmissibility of state interference in the affairs of the national football association.
“Here the question is on the verge of sports and state legislation. Everything related to the registration of a legal entity cannot be said to be exclusively football matters. They are regulated by the laws of Ukraine from the moment of registration, this is regulated by the state, and FIFA cannot influence this.
Moreover, the lawsuit was not filed by the state against the UAF, but the subjects of Ukrainian football are suing each other. And the state is only as an arbiter in this dispute in the form of a state court. The case in the Pechersk Court is precisely connected with the elections, namely, with the delegation of a representative of the association of veterans to the elections of the UAF. They seized on this, as I see it, and filed a lawsuit on this basis.
I do not see a direct violation of FIFA norms here, this issue is indeed regulated by the legislation of Ukraine. As far as I know, today the Court of Appeal has not yet scheduled the consideration of the UAF appeal to lift the ban - securing the claim, since the Pechersk Court has not yet transferred the necessary materials to the Kyiv Court of Appeal.
This lawsuit affects the emergence of the legal personality of certain structures in Ukrainian football — the ability to move on, the right to hold the UAF Congress, and so on. Does this make sense? In any case, we understand that until the official is re-elected, the person continues to perform his duties until the next election procedures take place, ”said the lawyer.
